These Terms & Conditions outline the rules and regulations for using the independent vertical portal / e-zine The Reverse Emo Changeling, accessible at https://reverse.emo-changeling.xyz.
The website is for informational, journalistic, and artistic purposes only. It is built as a 100% static monolith hosted on the Cloudflare Pages infrastructure. This translates to a complete absence of dynamic server-side scripts, user sessions, databases, and contact forms within the site itself.
Access to all publications is free and does not require registration or logging in. Users are required to use the portal in compliance with applicable laws, respecting the copyright of the authors publishing inside this e-zine.

§ X. Statutory Corrections & Replies
Any person affected by published information has the right to submit a formal correction regarding inaccurate or untrue statements contained in materials published on this website and the magazine's video channels.
Corrections must be submitted in writing within 21 days of publication, must be matter-of-fact, and must refer strictly to factual statements.
The editorial team publishes accepted corrections free of charge, at the earliest possible date corresponding to the original publication medium (website or video material).
The editorial team may refuse publication strictly in circumstances provided by statute, in particular when the request fails formal requirements, is non-factual, or violates applicable law.
In the event of a refusal, the applicant may pursue the publication of the correction through judicial proceedings.
§ X.1. Reporter’s Privilege & Confidentiality
The editorial team and contributing journalists protect data enabling the identification of confidential sources, as well as any information provided under professional confidence.
Disclosure of confidential journalistic sources is permissible exclusively in statutory cases specified by law and pursuant to a final, binding court order.
§ X.2. Prohibition of Press Criticism Suppression
It is unlawful to take actions aimed at suppressing or limiting press criticism, including exerting pressure, issuing threats, refusing information, or engaging in retaliatory measures.
Press criticism must be exercised responsibly and in accordance with professional diligence standards.
§ X.3. Obstruction of Journalistic Duties
Obstruction of journalistic duties is strictly prohibited, in particular through denial of access to public information, pressure, intimidation, or impeding the gathering of news materials.
Actions restricting the freedom of a journalist's work constitute a direct violation of the Press Law Act.

In accordance with the General Data Protection Regulation (GDPR / RODO), we inform you that the portal The Reverse Emo Changeling does not collect, process, or store any personal data of its readers.
No Data Collection: Due to the completely static architecture of the website, we do not run account registrations, newsletter subscriptions, or contact forms.
No Cookies: The website does not use tracking cookies or third-party telemetry scripts. Server logs (such as request IP addresses, browser user-agents) are automatically processed by Cloudflare Pages strictly for technical protection (DDoS mitigation, load monitoring). The Administrator does not link this log data to reader identities.
Comments (Telegram): All discussions and comments have been separated from the website codebase and moved to our official Telegram channel @emochangeling. Any comments or interactions occur natively on the Telegram platform and are governed by the privacy policy of that external service.

Experience suggests that many such communications are dispatched with admirable enthusiasm yet regrettably limited awareness of applicable law.
a. Jurisdiction & Governing Law
This publication operates exclusively under the laws of the Republic of Poland and the European Union.
- Applicable Substantive Law: Polish Press Law Act (Ustawa z dnia 26 stycznia 1984 r. – Prawo prasowe, Dz.U. 1984 nr 5 poz. 24) and Polish Copyright Act (Dz.U. 1994 nr 24 poz. 83).
- Jurisdiction: Courts of the Republic of Poland retain sole territorial and subject‑matter jurisdiction.
- Foreign Orders: U.S. subpoenas, court orders, or out‑of‑court demands possess no direct legal force within this jurisdiction unless formally recognised under Art. 1145 et seq. of the Polish Code of Civil Procedure (KPC).
We appreciate that this may differ from the expectations cultivated by certain American procedural habits.
b. Press Status & Protected Editorial Activity
This portal is operated as a registered press title under formal editorial supervision.
- Content labelled
[OPINION],[EDITORIAL], or[SATIRE]constitutes protected value judgments under Art. 10 ECHR and established ECtHR jurisprudence. - Reporter’s Privilege: Sources are protected under Art. 15 of the Polish Press Law Act.
Attempts to compel disclosure of sources should therefore be directed elsewhere.
c. Statutory Corrections Procedure
Alleged factual inaccuracies must be addressed exclusively through the statutory correction procedure defined in Art. 31a et seq. of the Press Law Act.
- Informal emails, automated templates, or demands issued outside the 21‑day statutory window do not trigger any legal obligations.
- We kindly note that “urgent” U.S.‑style correspondence does not accelerate Polish statutory timelines.
d. Improper Takedowns & Anti‑SLAPP
Unfounded or bad‑faith copyright/takedown notices submitted to hosting or CDN providers – particularly those invoking DMCA provisions that do not apply in the EU – may result in:
- Counter‑claims for damages under Art. 415 of the Polish Civil Code,
- Criminal reporting under Art. 44 of the Press Law Act (unlawful suppression of press criticism),
- Summary dismissal and cost‑shifting under applicable EU Anti‑SLAPP frameworks.
We trust this will encourage a moment of reflection before dispatching automated notices.
e. Service of Process
All legal notices must be submitted in writing, translated into Polish by a certified translator, and accompanied by proof of power of attorney (Apostille).
